Terms of Service
These terms are an agreement between you and Bill Harned ("we", "us") about your use of the YardMap app and this website. By downloading or using YardMap you agree to them. If you don't agree, please don't use the app.
What YardMap is
YardMap is a personal tool for recording where things are in your yard, such as sprinkler heads, valve boxes and shutoffs, and for finding them again. It is provided for your own personal, non-commercial use on your own devices.
Your license
We grant you a limited, non-exclusive, non-transferable, revocable license to use YardMap on Apple devices you own or control, subject to the Apple Media Services Terms and Conditions and the Usage Rules in them. You may not copy, modify, reverse engineer, or resell the app, except where the law says you may.
Your data
The pins, photos, notes and other information you enter belong to you. They are stored on your device and in your own iCloud storage; we do not receive or hold them. You are responsible for what you add and for keeping your devices and iCloud account secure. See the Privacy Policy for details.
Location accuracy, and a safety warning
YardMap uses the GPS in your phone, and the satellite photos in Apple Maps, to mark and show locations. Consumer GPS is often only accurate to several feet, and can be worse near buildings and trees. Satellite photos can also be offset from the ground.
Treat every location as approximate. YardMap does not show where underground pipes, wires, gas lines or other utilities run. Before you dig, trench or drive stakes, always contact your local utility-locating service (in the United States, call 811) and check the ground yourself. Do not rely on YardMap to avoid damaging utilities, property or yourself.
Information in the app
The head types, reach figures and other guidance in the app are general information and typical values. Your equipment may differ. Follow the manufacturer's instructions for your own system.
No warranty
YardMap is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the app will be error-free, always available, or that your data will never be lost. Please keep your own backups of anything important, for example by keeping iCloud on and by exporting or photographing key information.
Limit of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, property damage or personal injury, arising from your use of, or inability to use, YardMap. Our total liability for any claim relating to the app will not exceed the amount you paid for it, which for a free app is zero. Some places do not allow these limits, so they may not apply to you.
Updates and changes to the app
We may update, change or stop offering YardMap or any feature at any time. Where we can, we will avoid changes that make your saved information hard to reach.
Ending your use
You can stop using YardMap at any time by deleting the app. We may end or limit your access if you break these terms.
Apple
These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for YardMap, and is not responsible for any claims about it. If the app fails to meet a warranty that applies, you may tell Apple and Apple will refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may update these terms. The current version is always on this page, with its date. If you keep using the app after a change, you accept the new terms.
Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules.
